JAIPUR: A special Pocso court in Pali on Friday sentenced a 47-year-old man to 20 years of rigorous imprisonment for repeatedly raping his 14-year-old daughter, resulting in her pregnancy. The conviction comes nearly a year after the incident, despite the victim, her mother, and other family members turning hostile in court and attempting to withdraw the case.
The heinous crime came to light on August 6, 2023, when the girl’s family, including her father, mother, and maternal uncle, brought her to the district hospital in Pali after she complained of severe abdominal pain, vomiting, and nausea. Upon examination, doctors discovered that the girl was six weeks pregnant, prompting them to inform the Kotwali police station.
In her initial statements under Section 164 of the Code of Criminal Procedure (CrPC), the minor girl maintained that her father had been raping her for months and would beat and threaten her whenever she resisted. Based on her statements, an FIR was lodged at the Kotwali police station, leading to the arrest of the accused father.
During the investigation, the police obtained Forensic Science Laboratory (FSL) reports and medical reports related to the case. However, during the trial, both the girl and her mother turned hostile, with the victim claiming that she had made the statements against her father under pressure.
Sandeep Nehra, the special public prosecutor for the Pocso court in Pali, told TOI that when confronted about the pregnancy, the rape survivor and her mother were speechless. The matching of FSL samples of the accused and other relevant medical reports proved crucial in establishing that the girl had been raped by her father. “We had strong and incriminating evidence where police worked on minor things including ensuring that medical and FSL reports became a handy tool to corroborate that the girl was raped by her father.”
The court of special judge Sachin Gupta expressed that a father raping his daughter to the extent that she becomes pregnant is a heinous crime. After considering the evidence and witness testimonies, the judge sentenced the accused father to 20 years of imprisonment and imposed a cash fine of Rs 80,000.
