NEW DELHI: She got selected as a teacher in Uma Devi Children’s Academy, Khiri in UP and worked for six days but her services were terminated after the school management came to know about her gender orientation.
Frustrated but not shattered, the transgender woman travelled hundreds of kilometres to Gujarat’s Jamnagar and was issued an appointment letter to work as a teacher at JP Modi School.However, as luck would have it, just before she had completed formalities to begin life afresh with a stable job, the school management learnt about her unconventional gender orientation and chucked her out.
Finding the decade-old Supreme Court judgment in NALSA case crystallising the rights of transgender persons was of no help to secure her right to equal opportunity to work, the transgender woman has now moved SC seeking justice. The principal contention of the dogged lady, according to counsel Yashraj Singh Deora, is that discrimination, based on a person’s gender orientation, was violative of her fundamental rights.
A bench of Chief Justice DY Chandrachud, Justices JB Pardiwala and Manoj Misra needed no persuasion to entertain the petition and recorded in its order that the “transgender woman is aggrieved by the fact that her services were terminated by schools in UP and Gujarat immediately after her gender identity was revealed.” The bench issued notices to the UP, Gujarat and Union governments and the heads of the two schools. “We will do something,” the bench assured the petitioner when she sought interim relief.
