The Coalition will not support new migration laws, which the Albanese government wants to push through parliament on Wednesday.
Opposition home affairs spokesman James Paterson said it was “very difficult” for the Coalition to support the rushed legislation.
Labor dropped the Bill on Tuesday in a last-minute rush to legislate them before the parliament rises for a six-week break on Wednesday.
The Bill would mean detainees who have exhausted all avenues to stay in Australia could face up to five years behind bars if they refuse to co-operate with attempts to deport them.
“We are very concerned about unintended consequences,” Senator Paterson said, calling for a Senate inquiry.
