DEHRADUN: The judicial magistrate of Roorkee, Shivani Nahar, in Haridwar district, sentenced Babbu alias Balbir to a day’s imprisonment for rash and negligent driving in a 17-year-old case in which a person died. Balbir was convicted under IPC sections 279 (rash driving) and 304A (culpable homicide).
The court also imposed a fine of Rs 2,000 on him. The convict was driving a tractor-trolley on April 20, 2006, when he hit a man identified as Furkan Ahmed in Haridwar’s Manglaur area. While filing the FIR, the victim’s brother Habibur Rahman said that Ahmed was standing with his friends at Chaudhary market when a speeding tractor coming from Roorkee side crushed him. The prosecution produced three eyewitnesses to prove its case and two of them turned hostile, while one recorded his statement in support. While seeking maximum punishment for him, the prosecution said that innocent people are losing their lives in road accidents every other day due to the reckless driving of people like Balbir.
After reviewing the evidence and hearing the arguments, the court found Balbir guilty of careless driving. The maximum punishment under section 304A of the IPC is imprisonment for up to two years or a fine or both.

After examining statements, witnesses, and circumstantial evidence, the court found three of the accused guilty and sentenced them accordingly. The charges against the other three accused could not be proven.
Delhi court sentences man to 12 years imprisonment for aggravated sexual assault of minor
A 32-year-old man has been sentenced to 12 years of rigorous imprisonment under the POCSO Act for committing aggravated penetrative sexual assault against a minor. The Delhi court noted that the convict, who engaged in sexual offenses against children, displayed a “perverse mind” and did not merit leniency. The judge emphasized society’s responsibility to protect children from sexual abusers and stated that the penalty should align with the seriousness of the offense to serve as a deterrent. The court also dismissed the convict’s claim of mental illness.
