NEW DELHI: No reserved posts in central educational institutions (CEIs) can be de-reserved, clarified Union education minister Dharmendra Pradhan on Sunday.
The education ministry too issued a statement that reservation in CEIs will continue to be provided for all posts in the direct recruitment category, in the teachers’ cadre, as per the Central Educational Institutions (Reservation in Teachers’ Cadre) Act, 2019.
UGC’s draft ‘Guidelines for implementation of reservation policy of Government of India in Higher Education Institutes (HEIs)’, which is in public domain to seek feedback on stakeholders, drew criticism for the clause: “…A reserved vacancy may be declared unreserved by following procedure of de-reservation, it can be filled as an unreserved vacancy”.
MoE’s clarification came after Congress alleged this as a “conspiracy” to end reservation for SC, ST and OBC aspirants for posts in higher education institutions. Teacher associations, including Delhi University Teachers’ Association, also raised concern over this clause.
Pradhan told TOI: “There is no scope for ambiguity after the Central Educational Institutions (Reservation in Teachers’ Cadre) Act, 2019. Not a single sitting position will be de-reserved in the respective institutions. The reservations and the percentage stays as provided in the Act.”
UGC chairperson M Jagadesh Kumar clarified that there will be no de-reservation of reserved category positions in CEIs, and that it is important for all HEIs to ensure that all backlog positions in reserved category are filled up through concerted efforts.
According to the new guidelines, “A vacancy reserved for SC or ST or OBC cannot be filled by a candidate other than an SC or ST or OBC candidate. However, a reserved vacancy may be declared unreserved by following the procedure of de-reservation where after, it can be filled as an unreserved vacancy.”
